Egypt Issues New Executive Regulations on Refugee and Asylum Seeker Status: Legal Overview and Compliance Implications

Legal Update: Regulatory Framework Governing Refugee Status and Residence in Egypt

The Egyptian Government has issued The Executive Regulation of Law No. 164 of 2024 on the Asylum of Foreigners implementing the Law on the Asylum of Foreigners, introducing a structured legal framework for managing the status of refugees and asylum seekers in Egypt. The decision, issued by the Prime Minister, seeks to balance national security considerations, international obligations, and humanitarian commitments undertaken by Egypt.

The new framework establishes a transitional and administrative roadmap for regularizing the status of individuals registered with the UN High Commissioner for Refugees (UNHCR) and transfers key administrative competencies to the newly established national authority.

Key Legal Development: Transition to National Refugee Management System

Under the new executive regulations, a Permanent Committee for Refugee Affairs (the “Committee”) is designated as the central authority responsible for managing refugee and asylum-related procedures in Egypt.

The regulation provides for the gradual transition of responsibilities from international coordination mechanisms to a nationally administered system, including:

  • Issuance of new national refugee registration documents and cards
  • Management of asylum seeker databases
  • Coordination with international organizations, including UNHCR
  • Regulation of legal residency status for affected individuals

Transitional Validity of Existing UNHCR Cards

The regulation confirms that:

  • Existing UNHCR-issued refugee and asylum seeker cards remain valid until their expiry date, or until issuance of new national documents, whichever occurs first
  • Cards expiring within six months from the effective date of the regulation will automatically remain valid throughout the transitional period
  • This ensures continuity of legal status and prevents disruption to residency rights during the transition phase

Legal Obligations on Refugees and Asylum Seekers

The regulation introduces clear procedural obligations, including:

  • Submission of existing refugee and asylum seeker documents to the Committee at least one month prior to expiry
  • Notification to the Committee within six months for individuals whose documents have already expired before the regulation’s entry into force
  • Compliance with designated notification procedures as determined by the Committee

Failure to comply with these procedural requirements may affect the regularization of legal status under the new system.

Data Transfer and Institutional Coordination

A key legal feature of the regulation is the mandatory transfer of refugee-related data.

The Committee is required to:

  • Receive comprehensive refugee and asylum seeker databases from UNHCR
  • Coordinate with the Ministry of Foreign Affairs and relevant international bodies
  • Complete data transfer within a defined transitional timeframe

  • Foreign nationals residing in Egypt under UNHCR registration
